General conditions
Internet sales on the website are carried out by BITAX doo, Attemsov trg 9B, 3342 Gornji Grad, Slovenia. Identity number 1807340000.
Any person who registers on the website and orders at least one product electronically is considered a customer.
By registering, the buyer confirms that he or she is of legal age and has legal capacity.
Purchases on behalf of and for the account of minors and persons with complete legal capacity may be concluded by their legal representatives or guardians, and persons with partial legal capacity may conclude purchases only with the consent of their legal representative or guardian. Registration confirms the status of the buyer in accordance with the above.
BITAX doo bears no responsibility for any action contrary to the above.
All prices are expressed in euros and include tax at the applicable rate. Prices and other benefits that are in effect on the day the order is received are valid.
You will receive the original invoice upon payment or delivery.
The terms of purchase/sale of products through gardenshop.hr are determined by these General Terms and Conditions, which the buyer accepts when placing an order. The purchase/sale of products is carried out through the following stages: registration, order, payment, delivery, product return.
Registration
The customer is responsible for the accuracy and completeness of the data entered during registration. If there is any change in the data you entered during registration, please update your user account in the "My profile" section as soon as possible.
Ordering
Products are ordered electronically by adding them to the shopping cart. Products are considered ordered at the moment when the customer goes through the entire ordering process. We send a confirmation of order acceptance to your e-mail address that you provided during registration. If you do not receive an e-mail about the acceptance of the order, please check whether the products are in your basket and repeat the ordering process.
BITAX doo undertakes to deliver all ordered products that are in stock at the time of delivery. If BITAX doo is unable to deliver any of the ordered products, it will contact the customer by e-mail to provide a replacement product or cancel the ordered product. All other ordered products will be delivered.
Payment
The buyer undertakes to pay BITAX doo for the ordered products using one of the following payment methods:
-Online payment by credit card
-The card is not charged automatically, but only when the goods are shipped. When ordering, you will be redirected to the WSPay secure online payment system, where you will complete the purchase by entering your card number, security code and its expiration date. The card number is sent to WSPay via an SSL-protected connection. We guarantee the security of your data. The data is encrypted and cannot be misused.
-Internet banking, general payment slip
-You pay before receiving the goods.
Delivery
We deliver ordered products via the GLS delivery service.
Shipping prices include applicable tax.
For payment on delivery, a fee of €1.00 is required.

Delivery time is between 2 to 6 days. (depending on the individual country and the current situation in each country). During holidays (Christmas) delivery may be extended by an additional few days, so plan to order early. Delivery to islands may be extended by two business days.
The following are not included in the delivery deadlines:
-day of receipt of order;
-delay time due to incorrect and incomplete recipient address;
-delay time due to force majeure or traffic jams caused through no fault of our company;
-Saturdays and Sundays, as well as holidays and public holidays according to Croatian regulations.
Working hours for receiving orders are every day from Monday to Friday from 08:00 to 14:00.
Return and exchange
The ordered products will be stacked in such a way that they cannot be damaged by normal handling during transport.
The buyer is obliged to inspect the shipment upon receipt and if the shipment has external damage, he/she shall not accept it but immediately return it to the delivery person, noting that the product is damaged.
The buyer has the right to cancel the order and inform us about it by e-mail: Info@gardenshop.com or at the address BITAX doo, Attemsov trg 9B, 3342 Gornji Grad, Slovenia, within 15 days from the date of receipt of the shipment. The received products, together with the original invoice, must be returned undamaged in the original packaging and in the unchanged quantity within 15 days from the date of receipt of the goods. Otherwise, we will not be able to accept the return. The return costs are covered by the buyer. We will refund the money for the paid goods within 15 days from our receipt of the products. The cost of the refund is charged to the buyer.
If the order is cancelled and does not include a return of the product, but only a cash payment, the money paid will be returned to the buyer within 8 days of receiving the buyer's request for a refund of the amount paid.
The customer has no right to return the product in cases determined by Article 49 of the Law on Consumer Protection.
The customer has the right to an exchange, a refund or a voucher for the next purchase if a product that was not ordered is delivered or if it is a product with qualitative defects (destroyed plant, broken pots). Complaints must be reported to Bitax by e-mail at info@gardenshopsi.com. In the manner agreed with Bitax sales, the product together with the original invoice must be returned undamaged in the original packaging and in the unchanged quantity along with a written complaint that must contain the reason for the exchange within 15 days from the day of receipt. Otherwise, we will not be able to accept the return. Replacement costs are borne by BITAX doo
We ship ordered products immediately upon receipt of the goods at our warehouse.
Personal data protection
BITAX doo collects customers' personal data only to the extent necessary to fulfill its obligations, to inform about new and promotional products and to deliver promotional materials, to improve relations with customers and to check other data necessary for online shopping.
BITAX doo undertakes to protect the personal data of customers in accordance with the Personal Data Protection Act and undertakes not to disclose personal data to third parties in any way without the customer's consent, except for data that is necessary for business partners to deliver the purchased product. This excludes cases in which the Seller, by valid order of authorized state bodies, is obliged to provide or allow access to the personal data of customers in accordance with the law.
The customer has the right to request the addition, correction or modification of inaccurate personal data.
The customer may at any time request in writing a permanent or temporary ban on the use of their personal data.
Other provisions
BITAX doo is authorized to change the content of these General Terms and Conditions, product range, price lists, other information related to online sales, as well as all other content on gardenshop.hr without prior notice. BITAX doo is not responsible for any damage resulting from these changes.
The gardenshop.hr website includes links to other websites for whose content BITAX doo is not responsible or controlled, and therefore users access them at their own responsibility and risk. Advertising is possible on the gardenshop.hr website, and advertisers are responsible for ensuring that advertising materials comply with legal norms and rules. BITAX doo is not responsible for any errors or irregularities in marketing materials.
The content on gardenshop.hr is copyrighted and protected in accordance with the provisions of the Copyright and Related Rights Act, and may only be used for personal, non-commercial purposes.
The photos and descriptions of individual products may not necessarily be identical to the product. We strive to display and describe items as accurately as possible. However, we reserve the right to make errors in the description and photography of products.
BITAX doo is exempt from any liability for damage that may occur when using the website to devices that enable access to gardenshop.hr and to data stored on the same devices if the damage is caused by illegal actions of third parties, computer viruses, etc. BITAX doo is also exempt from any liability in the event of circumstances that prevent the use of the website.
When registering on gardenshop.hr, you will be required to create a password that you must keep to yourself and not share with other persons. You are responsible for all actions and orders placed under your user account. If you know or suspect that someone else knows your password, please contact us via e-mail info@gardenshopsi.com, so that we can provide you with instructions on how to change your password.
